Definitions
From exotic sports cars and luxury sedans to economy vehicles and SUVs, Notorious Drive features a wide selection of vehicles from manufacturers around the world, including Lamborghini, Bugatti, Aston Martin, Jaguar, Alfa Romeo, BMW, Mercedes-Benz, Audi, Koenigsegg, Tesla, Ferrari, Maserati, Porsche, Bentley, Range Rover, Rolls-Royce, Land Rover, Cadillac, Fiat, McLaren, Mini, Lexus, Tata Motors, Peugeot, Pagani, Toyota, Honda, Nissan, Ford, Chevrolet, Hyundai, Kia, and more.
Rental, Indemnity and Warranties
This is a contract for the rental of the Vehicle. We may repossess the Vehicle at your expense without notice if it is abandoned or used in violation of law or this Agreement. You agree to indemnify, defend, and hold Notorious Drive harmless from all claims, liability, costs, and attorney fees arising out of this rental and your use of the Vehicle. Notorious Drive makes no warranties, express, implied, or apparent, regarding the Vehicle, including no warranty of merchantability or fitness for a particular purpose.
Condition and Return of Vehicle
You must return the Vehicle to our rental location on the agreed date and time, and in the same condition as received, except for ordinary wear and tear. If returned after hours, you remain responsible for the vehicle until it is inspected during our next business opening. Any servicing or parts replacement during rental requires prior approval. You must check and maintain all fluid levels.
Responsibility for Damage or Loss; Reporting to Police
You are responsible for all loss, theft, or damage to the Vehicle, including repair costs, or the vehicle’s actual cash value if deemed a total loss, plus loss of use, diminished value, and administrative fees. You must promptly report any accidents, theft, or vandalism to Notorious Drive and the police.
Breach of Agreement
Prohibited uses include, but are not limited to:
(a) use by anyone not an Authorized Driver or without a valid license;
(b) operation under the influence of drugs or alcohol;
(c) providing false information to obtain the Vehicle;
(d) illegal activities;
(e) carrying passengers or property for hire;
(f) racing, contests, or teaching others to drive;
(g) transporting hazardous materials;
(h) operating outside permitted geographic limits;
(i) overloading;
(j) off-road driving;
(k) carrying more passengers than seat belts;
(l) transporting children without proper safety seats;
(m) tampering with the odometer;
(n) neglecting fluid maintenance causing damage;
(o) improperly secured cargo;
(p) misuse of a manual transmission if inexperienced;
(q) reckless or intentional misconduct;
(r) failing to notify police of accidents;
(s) damage caused by animals.
Any such actions constitute breach of contract. You waive all recourse against Notorious Drive for any resulting criminal reports or legal actions.
Insurance
You are responsible for damages caused to others. You agree to maintain valid auto liability, collision, and comprehensive insurance covering you, Notorious Drive, and the Vehicle. Where required by law, or if you lack coverage, Notorious Drive provides secondary auto liability insurance (“Policy”) up to minimum legal limits. We reject PIP, no-fault, uninsured, and underinsured motorist coverage where permitted. Insurance becomes void if you violate this Agreement or fail to cooperate in investigations.
Charges
You agree to pay Notorious Drive or relevant authorities for:
(a) time and mileage;
(b) additional drivers;
(c) optional services purchased;
(d) fuel shortages;
(e) taxes;
(f) parking, tolls, traffic fines, towing, and related costs;
(g) $50 plus $5 per mile for unauthorized returns or abandonment;
(h) collection costs, including attorney fees;
(i) 2% per month late fees (or maximum lawful rate);
(j) $50 or maximum allowed for returned checks;
(k) up to $350 for excessive cleaning if necessary.
Deposit
We may apply your security deposit toward any unpaid charges or damages incurred under this Agreement.
Your Property
You release Notorious Drive, its agents, and employees from claims for loss or damage to personal property handled, stored, left in the Vehicle, or at our facilities, regardless of negligence.
Modifications
No changes to this Agreement are valid unless documented in writing and signed by Notorious Drive. Extensions require the Vehicle’s return for inspection and a signed amendment. This Agreement represents the complete rental understanding between you and Notorious Drive, replacing all prior discussions or agreements.
Miscellaneous
A waiver of any breach does not waive future breaches. Acceptance of payment or failure to enforce terms does not constitute waiver of rights. Unless prohibited by law, you release Notorious Drive from consequential, special, or punitive damages relating to this rental. If any provision is deemed invalid or unenforceable, the remaining provisions remain in full effect.
